1. Acceptance of Terms
By accessing or using the OnTeam platform ("Service"), operated by OnTeam ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to the hosted service at onteam.work. Self-hosted deployments are governed by the MIT License under which OnTeam is distributed.
2. Description of Service
OnTeam provides a human resources management platform including employee directory, leave management, hiring, performance reviews, time tracking, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Account Responsibilities
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorized access to your account.
- You are responsible for all activity that occurs under your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Upload or transmit malicious code, viruses, or harmful data.
- Attempt to gain unauthorized access to other accounts or systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to store or process data in violation of applicable data protection laws.
- Resell or redistribute the hosted Service without our written consent.
5. Data Ownership
You retain all rights to the data you enter into the Service. We do not claim ownership of your employee data, documents, or other content. You may export or delete your data at any time. Upon account termination, we will delete your data within 30 days unless retention is required by law.
6. Service Level
We strive to maintain 99.9% uptime for the hosted Service. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by factors outside our reasonable control, including internet outages, third-party service failures, or force majeure events.
7. Payment and Billing
Paid plans are billed monthly or annually as selected. Prices are subject to change with 30 days notice. Refunds are available within 14 days of initial purchase if you are not satisfied with the Service. Failure to pay may result in suspension or termination of your account.
8. Limitation of Liability
To the maximum extent permitted by law, OnTeam shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless OnTeam, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Termination
Either party may terminate the agreement at any time. You may cancel your account through the account settings or by contacting support. We may terminate or suspend your account if you violate these Terms, with notice where practicable.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice within the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which OnTeam operates, without regard to conflict of law principles.
